DAT and Convoy Drop Lawsuits Against Each Other

On Monday, a federal district court in Oregon sent out a notice stating that the case between load board DAT Solutions and digital freight company Convoy has been resolved.

The notice states that after an out-of-court settlement, the parties have dropped their claims “with prejudice.” This means they cannot file new cases based on the same reasons.

The terms of the deal are being kept secret.

DAT and Convoy’s Legal Battle over Load Board and Trade Secrets

DAT sued Convoy in January 2022. They accused Convoy of breaking a contract and stealing trade secrets. Convoy for Brokers was released. It works like a load board. Convoy filed a countersuit. They claimed that DAT’s contracts hurt competition and broke Oregon and federal trade rules.

Judge Immergut’s Ruling in Favor of Convoy and DAT’s Potential Losses

U.S. District Judge Karin Immergut threw out most of DAT’s claims against Convoy in May. She let all of Convoy’s claims against DAT go on. It seemed like the scales had moved in Convoy’s favor. Convoy said that DAT’s load board fees are unfair. The fees are based on a deal that users can’t use other load boards. Convoy said an unfair deal with DAT prevented them from sharing data with other trucking rate analysts.

DAT stood to lose a lot and gain very little. Immergut could have said that its strict rules on monopoly were illegal.

Both companies may benefit from this approach. They can focus on running their businesses instead of going to court to protect themselves.
