Truck driver Jorge Rivera Lujan is the primary named defendant in that case.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">A three-judge panel denied both requests on Tuesday. In a footnote, one judge, Robert Wilkins, said he would have granted the stay.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Court_Timeline_and_Amicus_Participants\"><\/span><b>Court Timeline and Amicus Participants<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The combined cases will continue over the summer:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Petitioners\u2019 briefs:<\/span><b> June 15<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">FMCSA\u2019s briefs:<\/span><b> July 15<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Final briefs:<\/span><b> August 5<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Oral arguments:<\/span><b> September 2026<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The court also allowed additional parties to join as amicus curiae, including the Teamsters and the Sikh Coalition.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_the_Rule_Does\"><\/span><b>What the Rule Does<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">FMCSA issued an interim rule in October 2025, followed by a final rule in February 2026, effective March 16. The rule allows non-domiciled CDLs only for H-2A, H-2B, and E-2 visa holders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Groups excluded include DACA recipients, refugees, asylum seekers, asylees, and individuals with Temporary Protected Status (TPS).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Lujan plaintiffs argued the rule is \u201carbitrary and capricious,\u201d claiming FMCSA decided on the outcome first and then looked for reasons to support it.<\/span><\/p>\n<h2><b><img decoding=\"async\" class=\"alignnone wp-image-5475\" src=\"https:\/\/ladingcargo.com\/blog\/wp-content\/uploads\/2026\/05\/Trucking-Industry-1-300x108.jpeg\" alt=\"Trucking Industry\" width=\"842\" height=\"303\" srcset=\"https:\/\/ladingcargo.com\/blog\/wp-content\/uploads\/2026\/05\/Trucking-Industry-1-300x108.jpeg 300w, https:\/\/ladingcargo.com\/blog\/wp-content\/uploads\/2026\/05\/Trucking-Industry-1.jpeg 669w\" sizes=\"(max-width: 842px) 100vw, 842px\" \/><\/b><\/h2>\n<h2><span class=\"ez-toc-section\" id=\"Safety_Justification\"><\/span><b>Safety Justification<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The FMCSA says the rule is needed for public safety. State agencies have struggled to verify the driving records of non-domiciled applicants, leading to potential \u201cunchecked\u201d driving histories.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The agency identified 17 fatal crashes in 2025 involving non-domiciled drivers who would not have qualified under the new rule. These crashes caused 30 deaths and multiple injuries. FMCSA says drivers with approved visas undergo enhanced consular screening before entering the U.S., which the agency says reduces risk.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Supply_Chain_Impact\"><\/span><b>Supply Chain Impact<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The trucking industry is already feeling the pressure. In California, 13,000 licenses were canceled in a single day in March due to federal compliance demands.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The driver shortage is causing:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Higher freight costs as fewer trucks are available.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Insurance challenges for carriers employing non-domiciled drivers.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Service delays, especially for refrigerated shipments and port operations.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The Sikh community is particularly affected, as commercial trucking is a major profession for many members.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Industry estimates suggest 194,000 to 200,000 drivers nationwide could be affected by the new rule once licenses expire and renewals are restricted.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Carriers_Should_Do\"><\/span><b>What Carriers Should Do<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">For now, existing non-domiciled CDLs remain valid until their expiration date.
